Without a Colorado Springs business formation attorney, the two men conducted most business deals with a verbal agreement and a handshake, and are now facing a lawsuit against their lender for failure to pay on a nearly $9 million foreclosed loan.

According to The Colorado Springs Gazette, the city council president and his business partner formed a company called Northern Lights LLC.

The company was apparently primarily in the business of doing construction work on foreclosed homes that were bank-owned. The main bank they worked with, according to their countersuit, they did not have a formal contract. They had a “special relationship” with bank personnel, and agreed to do the work at a discounted rate, with the bank giving them an exclusive opportunity for the work.

The bank alleges that it loaned the company nearly $9 million – which it never paid back. The loan ultimately foreclosed, and that is the basis of the bank’s lawsuit.

The case has gone to trial, which is expected to last about a week.

The lawsuit is fairly complex, with a lot of he-said-she-said allegations and accusations being lobbed at either side. What’s important to note here is that in a number of dealings, the individuals at the center did not use a formal contract. Verbal agreements were the norm.

Under Colorado’s Consumer Protection Act, Section 6-1-105, deceptive trade practices, a person or company can be sued if:

Colorado Attorney General John Suthers alleges that the companies told potential customers that their purchase of a magazine subscription would support local charities, schools and overseas military members. In fact, they did not.

When customers tried to cancel their subscriptions, the attorney general’s office says, the company would not honor those requests. In some cases, when customers asked for refunds, they were told the company was actually out of business, which was false. In other cases, the attorney general’s office alleges that customers never received the magazines for which they paid.

This led to several hundred complaints filed with the Better Business Bureau, the attorney general’s office and the Federal Trade Commission.

In this case, the company at the center of this controversy is Delta Petroleum, which is headquartered here in Denver. It’s an independent gas and oil business, which is mostly involved in finding and acquiring crude oil and natural gas.

A class action lawsuit has been filed in federal court, alleging that the company violated the Securities Exchange Act of 1934. This is the law that governs secondary trading of securities.

The complaint says that the gas company either flat-out lied or indirectly mislead potential investors regarding information that may have shown their business model to be less-than-lucrative. For example, the plaintiffs say Delta didn’t tell investors it wasn’t setting enough money aside to be financial stable. They said Delta also inflated the company’s assets, while minimizing how much debt they were actually in.

What that meant for investors was that the stock was traded at a price that was far higher than it was actually worth. But then in late 2011, it was revealed that third quarter losses had reached nearly $430 million. Most of that was because of how much money the company had been paying to drill holes that were ultimately dry.

The company has said it may seek protection under a Chapter 11 bankruptcy if it’s unable to rectify its finances.

That’s because those with Denver trademark infringement cases could be impacted by how this case is decided. In fact, some 33 trade associations, companies, non-profits and sports leagues have filed briefs showing support for Rosetta Stone, which is renowned for its language lessons.

At the heart of the issue is whether company trademarks can be used by either counterfeiters or competitors – without the original company’s permission – simply by paying a fee to Google.

The program that may allow this is AdWords, which is a Google advertising software program. Rosetta Stone has alleged that Google allowed a competitor using the program to buy trademarked phrases such as “language library” and “Rosetta Stone” to sell their own, copycat language-learning software.The company says that in some of the instances, the links direct consumers to sites that hawk similar language-learning software, which may mislead them to think they are actually purchasing a Rosetta Stone product, when they’re not.

Back in 2010, a U.S. District Court dismissed the case. But now, the appeals court has overturned most of that original dismissal, so now the case can move forward in federal court.

Other companies have made similar filings against the search-engine giant, but this marks the first time that an appeals court has laid it out that a company can sue Google for trademark infringement based on the fact that links can confuse consumers.

This may possibly open the floodgates for a host of similar lawsuits, though that remains yet to be seen.

Google, though, argues that people can clearly tell the difference between what is a sponsored (or paid-for) link and one that will show up in the normal search results. A spokesman added that consumers are the ones who benefit when they can turn up results for a number of different – and competing – advertisers. They say that allowing consumers to use certain trademarked phrases to help them conduct a search assists them in making choices that are informed.

The most recent case spotted by our Denver business litigation attorneys deals with a suit filed by NoMedia Technologies Inc. against SpyderLynk LCC.

In the District Court of Colorado, NoMedia is alleging a patent infringement on two of the patents it holds on mobile barcode resolution technology. In short, think of the barcode scanners used in nearly every commercial transaction – from grocery produce to big-box store televisions.

Patent infringement is essentially the use of another person’s patent-protected idea or product without their permission. Such permission can be gained through licensing or some other agreement.

A lot of times, however, there is dispute over who thought of the idea first or whether the two products are similar enough to warrant an infringement allegation. These issues generally must be settled in court.

What makes this barcode technology so unique is that rather than the plain-jane, black-and-white models we’ve become so familiar with, these new barcodes will allow companies to encode their own logo or other specialized features on it. The new barcodes are called SnapTags. It also allows individuals to scan barcodes themselves using an application on their smartphones.

NoMedia is alleging that SpyderLynk heisted its patent ideas to hawk its own form of the emerging technology.

The lawsuit came after SpyderLynk announced its new SnapTag 2D mobile bar code product, using Patent No. 8,094,870. It was called “Encoding and Decoding Data in an Image.”

But NoMedia said it came up with the idea first – a point vehemently denied by SpyderLynk’s founder, who says her firm will aggressively fight the allegations.

NoMedia is trying to stop SpyderLynk from selling the SnapTags, at least while the issue is sorted out in court. Additionally, NoMedia wants SpyderLynk to pay not only for the initial infringement, but any lost business it may have accrued as a result of the SnapTag sales that have already been made.

In this case, Apple and large book publishers are accused of overcharging customers some $100 million for e-books through means that included artificial raising of the price. They reportedly did this by imposing a model of distribution that had publishers set the prices for best selling books at between $13 and $16, as opposed to the $10 they were actually worth. They reportedly did this because the cost of e-books was so much lower than the hardcover books they were used to selling.

What this meant for other businesses was that they could not compete, and customers were ultimately stuck paying more for products that weren’t worth as much as they were paying.

Colorado is one of 15 states that are alleging the price-fixing, and the U.S. Justice Department has also filed a lawsuit against the companies in federal court.

The U.S. Attorney General has been quoted as saying that high-level executives conspired to raise the prices – and eliminate any competition. They purchased rights from all the major e-publishing players so that they could artificially drive up prices.

While the federal government has agreed upon a settlement with three of these large publishers, which amounted to some $52 million. Still, it is moving ahead with its lawsuit against Apple, as well as Penguin Publishing Co. Ltd. and Holtzbrinck Publishers.

So for those who have purchased e-books at inflated prices – likely millions of people – will get restitution through the settlement, and possibly as a result of the lawsuit.

It’s estimated that in 2010, nearly 115 million e-books were sold in the U.S. for an estimated $442 million.

Few enter into an agreement believing that the other side will renege on the promises. Nowhere does that sometimes seem more true than in the dissolution of a marriage – especially when spouses are business partners.

That’s what has happened with famed country singer Randy Travis and his now-ex wife, Elizabeth Travis. The latter of the two, who served as her husband’s manager for more than three decades, is now suing for breach of contracted, following their divorce in late 2010.

The two had been married in 1991, and he had often credited his wife with not only saving him from a descent into alcohol and drugs, but also helping to boost his career. He was a night cook when the two met. She had secured a record deal for him that resulted in his 1986 hit album “Storms of Life,” which sold some 4 million copies.

Despite their divorce, the two had said they would continue with their professional relationship, with his ex-wife continuing to work as his manager.

However, early this year, the singer announced he had hired new management.

His ex-wife has since filed a lawsuit claiming breach of contract, saying that the singer took efforts to intentionally undermine not only her work with him, but also her work within the entertainment industry. She claims Travis hired an armed guard and several men who essentially stormed her Music Row office and then forcibly seized nearly all of the property therein, including computers, business documents and framed records.

She says that her ex-husband and his lawyers terminated their management agreement without any written notice.

There is no specific dollar amount that Elizabeth is reportedly seeking, though she is vying for a judgment in her favor.

A spokesman for the singer has denied her claim’s legal standing, though it remains to be seen how the court will rule.

A breach of contract in Denver can take on various forms, but it is essentially a situation in which one or more of the individuals involved either don’t hold up their end of the bargain or interfere with another party’s performance.

According to Reuters, Nike has won the first round court victory against competitor Reebok, blocking the latter from selling New York Jets clothing with Tebow’s name on it. The case, filed in New York, is called Nike v. Reebok.

Additionally, Reebok is being required to offer stores the option of buying back clothing from stores where the merchandise has already been shipped.

Tebow was just traded from the Denver Broncos to the New York Jets earlier this month. Nike filed the lawsuit earlier this week.

A federal judge in the case, however, declined to force Reebok to destroy any products with Tebow’s image or name that were created without authorization.

Nike’s lawsuit indicates that in a few days, the sports apparel company will start a five-year, exclusive contract with the National Football League to sell uniforms and other clothing items for more than 30 teams. The company further added that a contract that Reebok had held with the NFL players union to produce clothing products was already expired, prior to March, when the Tebow-apparel was manufactured. Nike went a step further in saying that Reebok was trying to capitalize on high market demand for Tebow sportswear during a brief window of opportunity before Nike’s contract officially started. However, they added that Tebow hadn’t given Reebok permission to use his name either.

No doubt, there is a great deal at stake, considering Tebow’s numbered Bronco’s jersey had been one of the highest-selling in the NFL. Historically, whenever a player is traded, demand for their new jersey will spike in the first several days following the announcement.  And Tebow has been named by a recent ESPN poll as not only the country’s favorite football player – but it’s favorite athlete.

According to Claims Journal, a wood pellet salesman from New York is claiming half ownership of the social media giant, saying Zuckerberg inked a deal with him back during his Harvard days.

Facebook denies this, characterizing the claim as fraudulent and opportunistic. In fact, attorneys say that the salesman has falsified documents, destroyed evidence and created phony e-mails to bolster his version of events.

The salesman says that he met Zuckerberg when the then-college student was hired to do some programming work for him. That much, Facebook’s attorneys concede. However, the salesman says it was around this time that he gave Zuckerberg $1,000 to help with a start-up then called “The Facebook.” The deal, says the salesman, was that Zuckerberg would give him half of the ownership rights if the company grew. The salesman said he lost a copy of that contract, and only recently found it while digging through documents in preparation for a fraud case against him.

Zuckerberg, meanwhile, says that the idea for Facebook hadn’t even yet been conceived. What’s more, his attorneys say the salesman has doctored evidence in an attempt to improve his claim. Forensic analysts with Zuckerberg’s legal team say the salesman “baked” documents in the sunshine in order to give them the appearance of age. They also say that the salesman changed the year time stamp on his computer, so that e-mails sent more recently would appear as if they had been sent years earlier. They also claim he got rid of evidence on his computer hard drive that would have backed Zuckerberg’s version of events, and failed to turn over that evidence to them, as required by law before the case goes to court. What’s more, they say, e-mails found in Harvard’s archive of Zuckerberg’s old student account don’t match the e-mails produced by the salesman.

Regardless of the outcome of this case (although it does seem somewhat clear what that outcome will be), the take-home point is this: In business, our ideas are the most valuable thing we have. Our Denver business litigation attorneys have been following the claim filed against technology giant Apple by a customer in a Los Angeles federal court.

The lawsuit targets the advertisements for Apple’s Siri smart phone product. Essentially, the Siri is intended to act as a computerized virtual assistant. The basic tasks of the product include Web surfing, appointment reminders and other voice command tasks.

However, the customer alleges that advertisements for Siri fudge on how far the technology actually goes. In one ad, individuals are depicted as using the application to find a restaurant, learn guitar chords to a favorite song or make appointments. The ads say it’s all as simple as asking Siri.

However, the complainant alleges that it’s not actually that simple. The Los Angeles Times reports that when the customer tried to use these features, Siri either couldn’t compute what he had asked or gave him the incorrect answer.

This lawsuit is on the heels of a very similar case also filed in California earlier this month. In that case, the individual had purchased an iPhone 4S that did not do what the ads had promised it would. For example, he asked the phone for directions to a location and to find a store. In those instances, the phone either did not compute what the user was asking, or after an extended time, gave him the incorrect answer.

One possible defense Apple may have in this case is that it is in beta, which means that it’s not actually a finished product, but rather, is a work in progress.

But federal laws governing fair advertising are pretty clear. Under the Fair Trade Commission Act, advertisers can’t lie about what the product is capable of delivering. They have to be able to prove their claims. And their ads have to be fair.

Even more laws may apply if the ad is for products like 900 telephone numbers or anything sold through the mail. Plus, each state has its own consumer protection laws that establish guidelines for the ads that can run there.

The state’s attorney general filed suit against the reverend, who also founded a local homeless shelter, alleging that he improperly used donations to cover personal expenses, such as his mortgage and other bills.

It doesn’t appear the church leader is denying that. But what’s at issue is whether the head of a church has the authority to use money donated to the organization to further the advancement of that mission – however he or she sees fit.

However, what the attorney general’s office is alleging is that the reverend personally selected his non-profit board members, who were complicit in the misuse of funds by misrepresenting to donors what the money was being used for. While on paper, the reverend was reportedly spending the money on one thing, he was actually spending it on another – i.e., cars, mortgage payments and other bills – to the tune of about $30,000.

An attorney for the reverend, meanwhile, says that the state’s action amounts to a meddling in the affairs of a church – something he doesn’t believe state officials have the right to do.

On Saturday, two adults and five children were rushed to three different hospitals following a major accident when the minivan in which they were traveling flipped over off of Interstate 25 near Fort Collins. Most seriously wounded was a 3-year-old girl who was flown by helicopter to Children’s Hospital in Aurora. One of the adults who wasn’t wearing a seatbelt was ejected from the vehicle.

The cause of the accident is still under investigation, but it’s just heartbreaking to see children get injured in any way, particularly in a car accident. In the wake of unemployment rates seeing their lowest rates in over 2 ½ years, Wall Street in turn had its own best week since mid-2009. While stocks dipped a bit on Friday, the overall week was way up, and overall indices remained steady. The Dow ended the week up seven percent. The S&P 500 was up 7.4 percent. NASDAQ was up 0.73 on the week.

However, while these are encouraging signs, there are elements that directly affect corporate law interests which must be taken into account. While the numbers of jobs that have been added are pretty vast, there have also been an estimated 300,000 people who have simply given up looking for work, and as such are no longer counted as unemployed.  In addition, the European markets are still having difficulties, and economists feel that stricter measures to control the Euro in the seventeen countries that use it as their primary currency must be taken, in order to restore market confidence in the floundering European Union economy.

However, even with these looming threats still in evidence, the simple fact of how good the past week has been is an encouraging sign. For far too many years the market has been gripped by terror of what was going on in the world of corporate litigation, in the employment market, in the political arenas, in the housing market.

Now, it seems, there are encouraging signs that these fears may finally be starting to dissipate. If the market can hold on just a little longer, there may finally be light at the end of this long, dark tunnel.

In the wake of the tenth anniversary of the downfall of Enron which you could argue was the beginning of the economic troubles that have plagued the U.S. and the world in the early twenty-first century, there is some news that his hopeful. The national unemployment rate in the United States has reached a level of 8.6%, the lowest rate in over two years.  This is especially encouraging since the level has sat steady in the neighborhood of 9% since March 2009, refusing to budge.

Economists believe that this sudden and sharp decrease in unemployment levels is as a result of small businesses who have finally begun to see reasons to hope in the economic climate. There were 120,000 jobs added to the economy in November, and the country has generated 100,000 new jobs per month steadily for the past several months. Corporate law attorneys like to see these kinds of numbers, because they mean an increase in clientele and a decrease in things like workers compensation and wrongful termination suits, as the working environment improves along with the economic climate.

In Colorado, 8,800 new jobs were created in October, the largest single-month gain in over four years. Local company OPX technologies expects to increase payroll by a massive 70 percent by the middle of 2012. Here in Colorado, new hires are described as being mostly technology oriented, not a surprise in today’s cyber-society. But it’s definite that there continue to be encouraging signs of improvement under the surface in the economy of the United States.

We heard a lot about all of the workers who lost their jobs when the company went belly up, of the people suddenly out of work and overqualified for many jobs left out there. What we don’t hear about very often are the people who retired from Enron and relied upon pension plans which suddenly weren’t there anymore.

Many of the employees of the now-defunct corporation were able to pick up and move on after the business’ dissolution in 2001. Some founded their own companies, some simply switched careers. But many were not able to move on. Many retired men and women suddenly found themselves penniless and forced to take part-time jobs to barely scrape enough money to make ends meet. Sadly, there was little to nothing that business law attorneys could do to help them—when a company vanishes, its assets are sold off and many of the bottom-end creditors never see settlements.

The tenth anniversary of Enron’s failure came on Friday, and it’s easy to look back now and say, “Oh, if we only knew…”

Everyone is tired of the struggles, of the desperation, of the difficulties in making ends meet. Try as they might, our government’s best efforts don’t seem to have fixed the problem, only maintained the status quo (which right now isn’t very good). But we don’t want things to just get totally better overnight.  This would be an illusory recovery, and recovery so fast and complete would only lead to a much bigger and worse crash down the road.

Like any wound, this one is going to have to get better in stages, in bits and pieces and baby steps. Solvent businesses need sustainability, and employees need stability.

Colorado has added 30,000 jobs since January 2011, and that’s a hopeful sign indeed. If the unemployment rate continues to drop a few points at a time, that’s a hopeful and consistent gain that can possibly be maintained and sustained, rather than a quick shot in the arm that will only alleviate the symptoms for a brief period before they come back with a vengeance.

The U.S. Government had been predicting a 2.5 percent growth in the economy through this year. Now, at the end of the third quarter, a public announcement that growth was actually now expected to be only 2 percent has caused stocks to slide on Wall Street, further damaging an already delicate situation.

Listen, you don’t have to be a business litigation attorney to understand that constant doom crying doesn’t help matters. Nobody needs constant reports on how badly the economy is doing.  What does the media and the government think that will accomplish? Do they think that by telling Wall Street everything is a mess, that will somehow magically fix things?  Do they think there’s actually enough goodwill in the market that people will just start buying stocks to make it better?

This sort of constant negativity and sensationalism of economic downfall hurts major corporations and it hurts small business. Freedom of information is a wonderful thing, but like any wonderful thing, it can be taken too far on principle. Or, put better, just because you have the right to do something, that doesn’t always mean it’s a good idea to exercise that right. Sometimes it’s best to keep your mouth shut, and what the media is doing in this case could be considered akin to shouting, “fire” in a crowded theater.

In this case, however, the situation is even more tragic. Police now believe (pending the results of a toxicology test) that the driver, Tyler Lovell, may have been drunk when his four-wheel-drive truck went airborne and struck the tree in Wheat Ridge, CO. There were two survivors of the accident, both of whom remain hospitalized.

Police are also investigating a nearby party where the teens may have been drinking prior to the accident, which occurred at 2:00 in the morning, but they say they do not expect to file any charges related to the accident itself.

This is probably a good thing—charging a deceased driver would be adding insult to injury. Colorado trial attorneys are all about upholding the law and the system, but sometimes filing charges just doesn’t serve any good purpose.

True, the party’s hosts could be held responsible, thus requiring a good lawyer, but even without charges, those who threw the party, those who allowed their friends to drink and to drive under the influence, are going to have to carry a lot of guilt with them for the rest of their lives. If they are remotely decent people, that may well be plenty enough punishment without adding criminal charges to the mix.

The reports and rumors had it that Liberty Media was increasingly interested in Barnes and Noble’s Nook Color “reader’s tablet” device, which it believed it could turn into a successful competitor against Apple’s iPad tablets.

Now, however, Barnes and Noble says that there is absolutely no truth whatsoever to the reports that a deal for the company’s sale had been reached, or even to the repeated speculation that Liberty Media is preparing to buy the retailer.

Such a merger would’ve been interesting to see play out, whether you’re a consumer or a business law attorney—much of the speculation centered around what would happen to Barnes & Noble’s many retail stores across the nation. Some said that Liberty Media planned to dissolve the brick-and-mortar locations (which would nullify some of the important in-store-based features of the Nook Color), while others said the plan was simply to open up the Nook while leaving B&N to operate much as it always had.

One thing is for certain: the landscape is changing for businesses across the country, and attorneys who provide business services need to follow the developments closely. When major retailers like Borders go out of business, and rumors abound that Barnes and Noble is for sale, it would appear that no retail company is safe from the onslaught of instant-gratification that Internet shopping provides.

The questions go beyond the bankruptcy courts. Now, Open Range’s creditors want to know where all the money went, as does a U.S. House committee that has been formed to investigate the claims regarding problems with the network vendors and quality, a sporadic flow of money from a $267 million federal loan approved and financed by the U.S. Department of Agriculture, and an inability to acquire the broadband spectrum required for the networks.

One thing is for sure—an investigation on this scale means that there’s going to be far more than a simple bankruptcy proceeding. Business litigation is sure to follow.

The situation is a mess—there are over 30 creditors involved, with eight based in Colorado, and many have claimed that they’ve had to lay off employees as a result of the company forfeiting its responsibilities. It’s not a stretch to imagine that other business and employment lawsuits will erupt tangentially to this one, like branches growing from a tree.

This isn’t the sort of news anyone likes to hear. Colorado, like every other state, has been through a lot over the past ten years, and to hear that so many companies are engaging in layoffs because of what appears a mysterious mismanagement of funds, is sad news indeed.

Under the incentive, if a company creates jobs that pay 110% or more of the average in the county where the jobs are located, they get a major tax break—in the case of the applicants this time around, there is the potential for up to $29 million in tax incentives.

There are, of course, those who will (justly) be concerned that these tax incentives are going to big corporations instead of small businesses, but the bigger picture is that these companies are creating very high paying positions which will enhance the growth of their home counties.

Qualified business law attorneys deal with clients of many different sizes, from mom-and-pop startups to Fortune 500 companies. The truth is, it isn’t evil to grant a corporation a tax break, depending on the nature of the tax break and what it accomplishes.

This is not the same as giving a corporation a major break to outsource jobs to India or the Philippines. This is a tax credit that will directly enhance a local community, and will not only keep jobs at home, but create new and high paying ones, and the money would directly benefit the local community at large. That can’t possibly be a bad thing.

However, a recent report indicates that employers in September posted the most job openings in the past three years. This is certainly an encouraging sign—could there be good (or at least, improving) times ahead?

Certainly the playing field is not level—competition for these jobs is high and fierce, and employers aren’t rushing to fill some of them, due to fears that the upturn may not be permanent.  Still, the simple news that the openings have been posted is encouraging, both for those looking for jobs, and for Colorado business law attorneys. The more solvent a corporation is, the less likely they are to face a spate of lawsuits from unhappy employees or ex-employees; in such an environment, corporate attorneys can focus more on helping executives build their companies and encourage growth, instead of defending them from lawsuits that don’t, in the end, advance any agenda.

On a greater level, of course, the news is simply good all around—nobody wants to see people out of work, and the economic recession in which the United States (and the world) have been mired for far too long has about run its course. It’s high time for a measurable improvement.

The measure was introduced to close a loophole that legislators claim has allowed casinos to pay far less in taxes than is their due, and as such has effectively cheated the state out of millions in deserved revenues. Regulators claim that forcing all casinos to operate under a single, unified retail license would close this loophole and allow the state to exercise a more even and fair regulation between all of the operations, as well as collect more tax revenue.

Contracts and licensing loopholes are an unfortunate and sometimes dirty part and parcel of business law. The language involved in these sorts of issues can make it difficult even for a trained and qualified attorney at times to find the truth through the web of legalese. Two different attorneys (and two different judges) can interpret the exact same contract or license in opposite ways.

There’s not enough information in the media for even the best Colorado business law attorney to make a truly informed judgment, but state Republicans are very much against the measure. They claim it is ill-conceived due to its failure to take into account the fact that even two casinos operating in the same building can have completely different corporate and operational structures. This, they claim, makes the proposed measure unfair.

The issue began in July when the division of wildlife merged with State Parks.  The merger was estimated to save $3 million to $4 million a year in costs, while maintaining revenue, a major advantage in these difficult times.

Nobody foresaw the accounting error amounting to over thirty million dollars. To say that such an error is alarming is a serious understatement. What causes such a massive error? The DOW claims that the error lies in its failure to account for spending on land and water acquisitions from the 2006-2007 and 2009-2010 fiscal years, and that makes up for the massive chunk of change missing.

Certainly accidents happen, but even in an organization the size of Colorado’s government, that’s a pretty huge mistake. This would, perhaps, be why the state legislature voted unanimously to allow the Legislative Audit Committee to conduct an investigation.

It will be interesting to see how this plays out, who ends up being responsible, and who takes the fall.  Audits such as this can take a long time to conduct—this one is expected to consume about nine months. Whoever ends up on the wrong end of this particular issue would do well to secure themselves a good business and trial attorney.

Once thing is certain; copyright law needs to be thoroughly reviewed and reformed. Few people discount this necessity, but nobody seems to be able to agree on just what needs to be changed, how it needs to be changed, or even what the point of copyright is. So we end up with quick fixes such as the Digital Millennium Copyright Act, a monster of legislation that was pushed through by special interest groups and directly contradicts without overriding decades of previous legislation.

A recent article in the Chronicle of Higher Education examines how to reform copyright law, and discusses how even James Madison, the first proponent of such a law, had his reservations. The article is informative, discussing how Madison even viewed copyright assignment as a kind of monopoly that should only be granted with great care. This sort of attitude is of great interest to those attorneys charged with defending the intellectual property rights of their clients.

Originally, copyright was designed to grant exclusive rights to a creator for a limited period of time, to ensure that creators could make a living from their creations and would thus be encouraged to continue to create. As the article points out, it has since been modified to be “statistically almost indistinguishable from a perpetual grant.”

How and if this should be reformed is an issue that isn’t likely to be resolved any time soon.

These sorts of surveys and research projects can be a lot of fun to watch, regardless of whether or not you are a business owner or employment law attorney, but they also serve a far more important purpose to those who pay attention to current trends in the industry. They show us one very important and crucial thing that can make all the difference in an era where the economy is really in the dumps.

These kinds of studies show us which businesses and employers are getting it right.

Employers and their business law attorneys should pay close attention to this study. By looking at which workplaces are declared the top ones in the city and region, employers can examine how such places do business, and look at why employees at these businesses are so happy. A lot of workplaces these days suffer from a problem of low morale, which leads to higher turnover, low productivity, and in the end, lower profits and more legal problems.

Company morale is important, and this study shows us which businesses have the best morale, which ones have employees that are the happiest in their jobs. By examining why, other local businesses can enact policies that mimic or mirror those who are getting it right, and can in turn enjoy the same sorts of high productivity and high morale.

The first step, of course, is to recognize that company morale is important, though of course, not at the expense of overall performance.

Franchising, in this economy, seems a great way to get one’s own business started, and as any politician will tell you, entrepreneurship is the driving force behind the American Dream. Business law attorneys are out there, eager to help aspiring business owners form their new business and get up and running. Unfortunately, it seems nigh impossible for a business to get credit these days.

The unemployment rate is up, which leads to part of the problem—without a current influx of cash, banks don’t want to take the risk of lending money that might not get paid back. Unfortunately it is this very high unemployment rate that has re-launched the entrepreneurial and pioneer spirit amongst many people. Business loans need to be based on business potential more than on the current status of the individual lender. This is a scary prospect, but any attorney versed in business and employment law can tell you that opening the doors to new businesses will give us the kickstart we need.

One glaring example of this new complexity in practice for business litigation attorneys is the fact that the United States Government has become concerned on some level about the foreign interests of U.S.-owned corporations. They have begun to ramp up enforcement of the 1977 Foreign Corrupt Practices Act, a law that was designed to prevent businesses from paying operatives of foreign governments for services rendered.

If this sounds like something that is uniquely relevant to the post-9/11 world, that’s because it is. We live in an era of fear of terrorism from foreign governments, and the government has good reason to want to keep a tight leash on any whisper of bribery from foreign governments. It falls, then, to the attorneys who represent major corporations to protect the rights of their clients against unfair accusations.

This is an area that is not always black and white, right and wrong. There are those who feel that the government has gone a bit overboard since 2001 in keeping things “safe and secure” for the people of the United States.

However, that is, after all, why attorneys exist. We must continue to exercise and defend our own rights and the rights of our fellow citizens in the face of tightening restrictions and regulations.

A recent editorial in the Detroit News lauds this decision. The Supreme Court, the article says, did the right thing by not allowing the suit to do what it calls “an end-around” a law banning suits against drugs that were approved for production and distribution by the Food and Drug Administration. It points out that one cannot blame the attorney for “going after the money,” due to the burden that Medicaid has been on state coffers, but it fails to note one important thing.

While the courts are not meant to make legislation, only to enforce it, is it not the duty of qualified trial attorneys to help interpret and point out the flaws in unfair laws?

Certainly here in Colorado, trial attorneys take this responsibility seriously—one can only assume that attorneys in other states take the responsibility just as much to heart. If nobody ever stands up to challenge unfair laws in courts, then unfair laws will abound. While it’s not the place of this blog, based on one editorial, to take a stand about this particular decision, it must be pointed out that it is not only proper for the state Supreme Court to review cases like this, it is their responsibility to rule on whether or not the laws being challenged are fair, just, and Constitutional. This is not making law. It is upholding the spirit of the core document upon which the laws are built.

Given that this is the third such ruling in different cases by different judges in recent days, it would seem that product liability attorneys are rather busy these days. Colorado product liability lawyers are always keeping an eye on these sorts of stories, particularly those involving multinational corporations.

Product liability is a serious issue—we live in an age where companies are cutting corners to stay solvent or, as unfortunate as it may seem, to keep profits up. Nobody wants to make less money, so the phrase “doing more with less” has become unfortunately common these days. This has, in some cases, had the unfortunate effect of creating product liability issues in cases where cutting corners has led to lower quality or outright shoddy products through a lack of quality control.

While the verdict in this current case renders it far from over—the appeals are still promised and pending—it’s an example of how far product liability can reach. The companies claim that the drug in question was properly manufactured with full quality control, and that the outbreak could’ve been due to unsafe employee practices at the delivery points.

If this is true, should the drug companies be held responsible? This is an issue that is for the courts to decide—all qualified personal injury attorneys can do is make arguments for their clients. But the law, and responsibility for how products are manufactured and used, has a long arm, and only the future will tell how long it will grow.

We live in difficult economic times. We have recently come through what many have called the worst recession since the Great Depression. Indeed, some say that we have not actually come through it and that the worst may still be ahead. Regardless, the times have been especially difficult with workers, both those unemployed and those who have jobs.

For those who have jobs, they are facing circumstances where employers are doing more with less; job responsibilities are up and hours are longer, but pay is down. For workers, this can mean enduring difficult personal and professional environments. For employers, it’s important to keep in mind the idea that just because jobs are tough to come by, you should still treat your employees as important members of your team.

Workplace harassment claims are some of the worst kinds of employment law suits, with accusations often flying from employee to employer and vice-versa. It’s important for employers to avoid feeling that the disgruntled employee should be happy just to have a job in this climate—this type of attitude only hurts the employer when the lawsuit comes down. Rather, to survive such a suit, the employer needs to work with his or her employment law attorney to establish a history of respect for and fair treatment of employees.

Also, don’t assume that the disgruntled employee is just out to make a quick buck in a difficult economy. By painting the employee as a villain in your own mind, you risk ending up making yourself a villain in the long run. Rather, talk with your workplace attorney and examine things from the employee’s point of view. That way you can better help your attorney construct a valid argument, litigate the complaint and come to a fair resolution.

The term “retroactive copyright” refers to the idea that when copyright terms are extended, works that had previously been in the public domain are returned to copyright protection. This can cause all manner of problems to those who had relied on the concept of public domain to produce derivative works based on the public domain work, or who simply published the work in question.

The idea of public domain is one that is important to copyright law. These days, in an era when copyright equates to control rather than to a concept of encouraging sharing of work, this important concept—that a work must become available to everyone after a certain reasonable period—is not only forgotten, but actively campaigned against by proponents of expanded copyright. Copyright attorneys often get caught in the middle, on one hand obligated to defend the rights of copyright owners, but just as often defending those who are operating under the auspices of public domain or Fair Use.

This particular case has gone back and forth for years; originally a court ruled that retroactive copyright was unconstitutional; an appeals court overturned that decision. Congress wants complete and unlimited power over copyright law, arguing this resides in the Constitution despite the First Amendment. Now the argument has reached the Supreme Court, and copyright and trademark lawyers all over the nation are waiting to see what the outcome will be.

Sony Records, who has owned Epic since the 1980’s, has been sued by Popovich several times; in the late 90’s a suit was filed claiming that Sony had misreported earnings from the album, to the tune of millions of dollars.  He also sued Sony a few times for breach of contract, and in 2002 was awarded $5 million for his troubles.

These are the kinds of cases with which good copyright attorneys have a field day. All too often the little guy is afraid to stand up against the major corporation because of the power and money corporations hold, but the Popovich story is one that shows with a strong business attorney in your corner, money and power don’t have to spell the outcome of a litigation.

In this case, the Popovich estate stands to win a lot—not only are they seeking a court order allowing them to examine all accounting files, but they are claiming that Sony has gone so far in breach of its contractual agreements, that Cleveland International Records (and by extension, Popovich’s estate) should gain all rights of ownership over the album.

If such a ruling goes in favor of the estate, there is more on the line than just the millions of dollars associated with one of the best-selling albums of all time. In fact, the precedent set by such a ruling could have huge ramifications all across copyright law and set the stage for decades to come.

Most of the issues she faced are resolved—her car is repaired, though she has to go through a lot of grief when the insurance company makes the check out to the wrong party. Her mother, who was in the car with her, gets checked out by a doctor and is cleared as okay.

The problems begin with the emotional distress she suffers due to the accident. It starts with her lost work time—she had to take days off to get the car repaired. Then, she goes to get a rental car and is told that she doesn’t carry rental coverage on her insurance, and the man who hit her? His insurance company will only cover a fraction of the cost. Her insurance company refuses to sue for the remainder, instead recommending that she add more coverage to her own policy. She ends up a few hundred dollars out of pocket due to the need for the rental car.

This is how insurance companies work—they are in the business of making money as much as they are of protecting clients. Personal injury attorneys, however, see their livelihood intertwined with protecting clients’ rights. Had the woman had a Colorado motor vehicle accident attorney at her side, she may not only have gotten the rental covered, but additional moneys to cover her emotional trauma.

The issue of employment unions is something of a hot button these days; we live in a difficult economic climate, where jobs are tough to come by. As a result, in some areas workplace and working conditions have gotten more difficult, with employers (who are suffering as well) trying to do more with less. This leads to more incidents of employees making accusations of being (or simply just feeling) overworked and mistreated.

This climate has brought issues of workplace bullying into the spotlight. And perhaps most importantly, the idea of unions enjoying resurgence is becoming more prevalent.

Why is this new law important to employment law attorneys, particularly those who support corporations and management more than workers? That’s simple: keeping yourself and your employees informed almost always aids in your own protection. Laws like this serve as a reminder to employers to cover themselves, to minimize employee claims of mistreatment, harassment, or hostile conditions. The more you keep an open line of communication with your employees, the more likely you are to avoid lawsuits in the future, or to protect yourself when the inevitable accusations do arise.

If you’ve kept everything above board, been open with your employees, and can demonstrate this, your Denver employment law attorney will be better able to protect your life. Laws like this are useful to that end.

Certainly, as science improves, we discover new information about brain injuries and the long-term effects of concussions. Certainly, we should watch out for the health of not just public figures, but private sector individuals as well. Public figures tend, obviously, to be more visible and it is perhaps unfortunate that we treat them differently than people who aren’t famous. That’s why personal injury lawyers are so important. Unless a story is so huge as to make national news, the media and people around the nation won’t advocate for victims of traumatic injuries. Experienced injury attorneys exist to do just that.

It’s clear that we’re nowhere near the end of the “brain injury saga” that is currently playing out in the professional sports landscape. Still, as irritating as it may be to fans of the sports effected, if the attention brought to brain injuries through this landscape trickles down to the private sector and helps every day, average Joes and Janes, isn’t that a good thing?

Bavis, a hockey talent scout who was only 31 years old, was on the second plane to hit the World Trade Center towers. His family subsequently filed suit against U.S. Airways, saying that the company should be held publicly responsible for negligence and security holes that enabled five terrorists to board and gain control of the plane. For this reason, the family also resisted multiple settlement offers from U.S. air for a very long time.

Now, finally, the family feels said accountability has been gained.

Defense attorneys for U.S. Air filed a motion to dismiss the case, which enabled wrongful death attorneys for the family to file a detailed compendium of evidence against the company—a compendium that will forever be a matter of public record.

There’s no doubt that these suits, combined with increased security regulations in the post-9/11 era, have harmed the airline industry. While the exact amounts are secret, it is estimated that some $500 million has been paid to claimants in wrongful death suits following the tragic attacks. Still, it is important that victims get their just due, and in many cases the major thrust of the lawsuits were not simple monetary gain, but a chance for the families to tell their stories on public records. Colorado personal injury attorneys can relate to this goal; it shows that there is more to these types of suits than the greed to which they are often attributed.

Thousands of musicians championed the law, known as “Cliff’s Law” after Sir Cliff Richard, its most high-profile proponent, pointing out that they stood to lose vast amounts of money in royalties, as their publications from the 1960’s would soon enter public domain in the European Union.

The new law, which will be implemented by member states in 2014, marks a significant victory for the music industry, which has long battled piracy through everything from copied CDs to Internet file sharing. Hundreds, if not thousands, of copyright litigation cases have been filed not just in the United States but the world over. The law marks a loss for champions of less restrictive copyright law, who feel that copyright has been altered from its original intent as a means by which artists can make a living from their craft, to a means by which corporations can have control over intellectual property rights.

Here in the U.S., Denver copyright litigation attorneys will continue to serve clients of all sizes, from individual artists and small businesses, to large conglomerates, to ensure that copyright and trademark ownership is enforced according to the laws on the books. Still, the recent developments are exciting and interesting, and we will continue to watch as events play out.

Scholars are some of the worst offenders in the recent issues of copyright infringement. There is a sense among academia that all information should be freely and widely available, despite its status in copyright. These people forget the core idea behind copyright: that authors and artists need to be able to make a living from their work, or they have no reason to continue to produce it. The idea that creators will create just because of the joy of doing so, while it may have some intangible merit, is naïve and foolhardy.

One wouldn’t ask a mechanic to fix cars for free, just because he loves doing it or expecting a business to give away products and services without some sort of business litigation. Why is a writer different?

Copyright law may be out of hand in some ways—it has turned into an estate and corporate rights issue rather than one of allowing authors to make a living—but it is what it is, and fighting it by ignoring it doesn’t help the issue.

The West Virginia Record recently reported that a contractor is suing the Board of Education in Putnam County, West Virginia, for breach of contract for failing and refusing to pay for work the contractor did on a school project. The suit seeks damages with interest. According to the suit, the contractor alleges that the contractor was hired by the Board to perform the school project for over $700,000.

The plaintiffs allege that the Board failed to provide accurate and adequate project plans, contract documents and project specifications that described the work to be performed, resulting in project delays and increased project costs. In addition to refusing to pay for work the contractor did complete, the Board is accused of refusing to consider, process and execute change orders.

The Board of Education in this case apparently did not have a project management plan in place before the project began. A project management plan is a report that includes details about the project such as project location and type, a scope of the work to be performed, the cost, the staff assigned to the project and project completion dates. This lawsuit stemmed from poor planning on the part of the Board, and now they can only hope their business litigation attorney can prevent them from having to pay dearly for their project mismanagement.

The Clinton Herald recently reported that the former administrator of the Clinton Humane Society filed a lawsuit against the organization when she was terminated from her job in July 2010, citing breach of contract. Her contract with the humane society was for four years. She was into the third year of the contract when she was fired.

The humane society denied the breach of contract allegations. According to the suit, the humane society stated that the administrator was terminated because she created an atmosphere that was stressful to employees, and she displayed unprofessional and inappropriate behavior when dealing with employees and board members.

The judge ruled in favor of the humane society, finding that there was just cause for the administrator’s termination. Employees’ testimony revealed that the atmosphere at the humane society was so tense that employees felt they walking on eggshells under the administrator’s supervision. In addition, the administrator would reportedly storm out of board meetings and clean out her office. Thus, the court found that the humane society was justified in terminating her.

Obviously the former administrator’s actions contributed to her losing her case. Court documents state that the student and the alleged victim had sex in his dorm room in August 2008. The woman stayed in his room for a few hours afterwards, then left and called police to report that she had been raped. The alleged victim met with a dean at the university and told the dean about the rape and made a written statement.

Based on the her statement, the dean determined that a rape did occur and immediately began an investigation. The dean later spoke with the accused student and informed him that he was charged with violating the university’s sexual harassment and assault policy. The student was told that the faculty committee would hold a hearing the next day. He was instructed to bring a character witness and meet with a faculty-appointed advocate before the hearing. He was also told he would not be allowed into the hearing unless he was called to make a statement. The dean then asked the student to provide a written statement and advised him to say he was too intoxicated to be aware of his actions and that he was sorry.

The committee found the student guilty and informed him he had two days to leave the campus. He was advised that appealing their decision could result in a harsher punishment and cause the alleged victim to press criminal charges. According to the student’s attorney, he had the option of leaving school for a semester and reapplying for admission with the incident on his student record or leave the school for a year and apply again with a clean record.

The student chose the one-year option, but instead of returning to school, he and his parents sued the university for breach of contract and negligence, claiming the student was denied due process. According to the news story, his attorneys plan to closely examine the process that led university officials to expel the student, as any capable business litigation attorney would. If the university is found to have acted inappropriately, the student would be victorious and get the compensation he seeks and deserves.

The tenant, who pays over $500 a month for rent, claims the rent money went toward electrical and other repairs she paid for after the landlord failed to respond to her written requests to address the issues. Among the many issues the tenant claims are a faulty shower hose; lack of a vertical hand-railing on the tub; a non-functional thermostat; bedrooms windows that don’t open wide enough; no rear doors, leaving her bedroom window as her only emergency exit; and a bathroom vent that runs nonstop and can only be turned off by shutting off power to her bedroom. She claims other neighbors have similar complaints but none were willing to make any statements.

The executive director insisted that all and any complaints have always been addressed in a timely fashion and that the development is in beautiful shape. She further stated that they had a long waiting list of rental applicants. However, when asked to provide a specific number of complaints received, she stated replied that such requests had to go through the EBCDC attorney, who was unavailable for comment.

The tenant’s concerns may be well warranted, but she is still responsible for paying her rent. The landlord has a responsibility to address all tenant concerns and issues, which the landlord in this case claims to have done. According to a recent InMaricopa article, the couple thought they were current and was caught off guard by the notice. The property management company allegedly demanded $20,000 in a week or they would lock the couple out of the center. They were also informed that their monthly rent would increase beginning in January 2012. The couple claimed that the planned increase was a breach of contract, because their rental agreement stated their rent would not increase in 2012.

The owner of the business center acknowledged the agreement, but he told the couple they had to discuss the matter with the property management company. According to the owner, the couple paid a reduced rent when they first began leasing space in the business center. The rent payments were to incrementally increase. An amendment was made to their lease in February 2010 because they fell behind even with reduced rent. The owner insisted that he tried to work with the couple as he did with all his clients and had forgiven CAM charges when the couple fell behind in the past.

The couple’s business litigation attorney advised them to move rather than fight the property management company. The owner of the business center called the move “criminal”, but he had no plans to press legal action. He said he had planned to lower their rent before they moved out.

Fortunately for this couple the business center owner decided to “let it go” rather than drag them through a court battle. However, the property management company is the leaseholder in this case, and they may feel differently. The couple could still find themselves in a legal battle should the company elect to take legal action to get the unpaid rent.

According to the Worcester Telegram & Gazette, the married couple rented from the landlord for more than two years with no issues until their rent fell behind a month. When the landlord inquired about payment and informed them that he would sue them, they threatened to “make his life miserable”. They began filing unfounded complaints to the health department. Then they began making allegations of racial discrimination against neighboring tenants on the third floor of the building they lived in. The wife accused the tenants of egging her car, making ethnic slurs toward her and harassing her and her children.

The landlord investigated the incident and found no evidence that it ever happened. He talked to the third-floor tenants, warning them that they would be evicted if they continued to harass the couple. The third-floor tenants denied any wrongdoing and accused the couple of causing trouble. They felt they were targeted by the couple because they were overhead saying they were going to inform the landlord that the husband was an alleged drug dealer. They filed a restraining order against the couple, who in turn filed one against them.

They couple moved in August 2010. They sued the landlord for $10,000 in damages. A complaint they filed with the Massachusetts Commission Against Discrimination (MCAD) alleged problems with the third-floor tenants and that the landlord did nothing to rectify the problems. The Attorney General’s office determined that the landlord failed to properly intervene in a dispute between his tenants. He was found to be in violation of state anti-discrimination laws by failing to take action against the third-floor tenants. His attorney advised him to agree to a settlement. He was ordered to pay his former tenants $2,000 plus $2,500 to the state, the latter of which would be suspended if he complied with other terms of the settlement.

The landlord was not happy with this outcome, but he wanted a quick resolution to an ordeal that caused him a lot of emotional anguish, even if that meant taking the blame. He could have fought longer to prove he did nothing wrong, but his attorney advised him that it could cost him much more money than it already did. The lawsuit accused the defendants of failure to issue a notice of termination notice and breach of contract. The plaintiff seeks lost wages, $200,000 severance pay, vacation and sick pay, attorney fees and court costs. The plaintiff stated in a phone interview that he tendered his resignation in October 2008 and he was fired after he turned in his resignation, which the plaintiff found out upon his return from vacation. The vote to terminate his employment took place was held while the plaintiff was on vacation. The plaintiff claimed he was fired after he issued a memo informing them of inappropriate conduct by a former solicitor who had worked for the township.

The plaintiff and his attorney tried to work with county officials to resolve the dispute, but efforts to arrive to a resolution failed. The plaintiff is currently employed a consultant for another firm that provides management support for local governments. According to the suit, the principal and school superintendent were looking to hire a special-ed teacher. The principal suggested to a former colleague that he should apply for the position. The colleague did apply, but the superintendent declined to interview him. The principal told the colleague that he was not going to get an interview. The colleague complained to a member of the school board. When the superintendent found out, he accused the principal of divulging confidential information to a job candidate. He then made a recommendation to the school board to reverse the decision to rehire the principal. The board agreed, and the principal sued.

The presiding judge in the case found that the contract between the principal and the school district was an oral one, which was insufficient to sustain her case. The law in Colorado requires public school contracts be in writing. The principal argued that the board meeting minutes constituted a written contract, but the judge disagreed. The principal also argued that the school district violated her right to due process by denying her a chance to defend herself. The judge acknowledged that the principal did not receive due process, but as a school administrator, she had no tenure nor any right to continued employment at the school.

Any and every contract executed should always be in writing. In this case, a written contract was required by law. Without it the principal’s case had no leg to stand on. The suit alleged that NHA forced COTR to pay inflated prices for food and other services and canceled a key contract after they agreed to an extension. COTR accused NHA of repeatedly threatening to cancel their contract with COTR unless the company agreed to NHA’s demands.

NHA officials denied COTR’s claims and said the legal action was retaliation for the non-renewal of the contract. COTR was also accused of using smear tactics. NHA said that COTR was in non-compliance with financial standards set by the agency and the federal government.

NHA had previously been accused of mismanagement. The agency had experience problems with Head Start, which generated the majority of the agency’s annual revenues. State records showed that between 2002 and 2007 NHA lost track of 15 children for short periods of time. None of the children were harmed. A local newspaper also exposed a massive theft ring involving a food bank that was a former NHA program but has since become a separate charity.

They also said they would pay in weekly installments. The defendants attempted to make a partial payment, but it was refused because it was not in accordance to the terms of the agreement. No subsequent payments were made toward the balance.

The plaintiff has a good chance of winning this case if he retained a good business litigation attorney. One of the owner’s stated that losing the dive shop, however, would cause her to go out of business. She sadly added that she laid off all of her employees and was unable to keep up her  insurance and mortgage payments.

Feeling threatened, the husband called police.

The landlord insisted that he was talking to the tenant’s wife because her name was on the lease. He admitted that things escalated out of control but faults the husband for trying to provoke him into a physical fight. He also denied yelling or waving his finger in the wife’s face. Turns out the landlord/council candidate has a reputation for having a temper. He blew up at a council meeting in 2006 and went into a physical;y intimidating tirade, which he dismissed as an isolated incident.

Even though no one got hurt and no fists flew, the landlord could have avoided such a confrontation by keeping his temper in check and consulting with a business litigation attorney before his visit to the tenants. The men got into heated argument when the landlord came to collect the rent. The tenant went inside his house and returned with a sword. He slashed the landlord across his abdomen and fled the scene. Authorities tracked down the tenant less than an hour later in a Walmart parking lot. He was put in jail with a bond set at $50,000. Police did not what type of sword the tenant used nor its whereabouts. They believe the suspect disposed of the sword someplace between his home and where he was arrested.

The tenant is a tragic example of why it is always best to let cooler heads prevail. The landlord in this case is very lucky to be alive. The story did not state the exact nature of the landlord’s relationship with his tenant, but his sword-slashing reaction is a telling sign that it was not a good one. The landlord alleged that there were noise complaints stemming from two parties the tenant held at her residence on February 6, 2011 and June 24, 2011. The tenant stated she had gotten permission to have the parties from the landlord’s husband.

A dispute over the use of an above-ground swimming pool had also occurred between the two women that led to police intervening and arresting the tenant. The landlord stated that the pool was for use by all the tenants in the unit. The tenant was under the understanding that the pool was solely for her use, since she was told she alone was responsible for maintenance of the pool. Therefore, when the landlord’s son wanted to use the pool, she expected he would ask her permission beforehand. The landlord’s son felt differently, since the lease contained no clause specifying he needed the tenant’s permission.

The landlord’s attorney stated that the pool was not found to be part of the lease agreement.

The dispute over the pool escalated to the point where the tenant angrily cut the pool, causing gallons of water to leak into the yard and onto the street. The landlord received an estimate of $1,050 to repair the pool.

The tenant’s lease was contingent upon receiving HUD assistance. The judge voided her lease agreement, producing a letter from HUD that stated the tenant was terminated from the program. The tenant was given 10 days to appeal or vacate the premises. The tenant planned to appeal both HUD’s decision to terminate her as a client and the judge’s ruling to terminate her lease.

CME security personnel began monitoring the former employee’s computer activity in May of 2011. They discovered thousands of files had been downloaded to his computer, some of them copied to removable storage devices. Richard J. Gleason has practiced for more than 20 years in the fields of commercial litigation, personal injury litigation, municipal law and business representation. Prior to practicing law, he worked as a certified public accountant for a Big Four accounting firm. Mr. Gleason is a graduate of Colorado State University and the University of Denver College of Law.

Mr. Gleason served as an assistant city attorney for two Denver metro cities for more than eight years. In addition to litigation, he has worked extensively in the areas of land use, construction, and liquor licensing.

Mr. Gleason’s practice is founded on his understanding that people engage attorneys in order to achieve solutions to problems and to resolve disputes. He is committed to providing the most cost-effective means of achieving his client’s objectives. Since graduating from the University of Tennessee College of Law with High Honors in 1982, Thomas J. Overton has practiced exclusively as a trial attorney. Mr. Overton is certified as a Civil Trial Advocate by the National Board of Trial Advocacy, an organization accredited by the American Bar Association. Mr. Overton is trial tested.  He has been lead counsel in numerous trials and appeals in both federal and state courts in Colorado and across the country.

Mr. Overton acts as a Hearing Officer for the Colorado Supreme Court Attorney Regulation Board.  He has served on several community boards, including the Denver Children’s Home (past president) and the Colorado Inter-mountain Fixed Guideway Authority.  He is also active in the American Inns of Court.

Mr. Overton founded the predecessor of The Overton Law Firm in 1991 after spending several years with a national law firm. His clients include multinational corporations, professionals, entrepreneurs, small and medium sized businesses, and individuals and families.

Mr. Overton is committed to fighting the battles that have to be fought to protect his client’s rights and interests.
